Mirel Fisch, Esq. represents individuals who have been subjected to false arrest, malicious prosecution, wrongful conviction, and other serious constitutional violations. Her work in this area also includes representing individuals who were assaulted while in custody, or families pursuing civil rights claims arising from deaths in police custody.
Ms. Fisch has represented individuals who were falsely charged and convicted of serious crimes, including cases in which individuals served decades in prison before their convictions were overturned.
She has litigated 42 U.S.C. § 1893 civil rights actions against municipalities, police departments, and prosecutorial offices in both New York and New Jersey.
In New York, her work has included matters involving the New York City, the Kings County District Attorney’s Office, Nassau County, Suffolk County, and other local municipalities.
In New Jersey, she has litigated cases involving the City of Newark, the Essex County Prosecutor’s Office, the Camden Police Department, the New Jersey State
Police, and other local municipalities.
In addition to federal civil rights litigation, Ms. Fisch represents individuals pursuing statutory compensation claims for wrongful conviction and imprisonment. Her work includes representation in New York under Court of Claims Act § 8-b, which provides a civil remedy for unjust conviction and imprisonment, as well as claims under New Jersey’s Mistaken Imprisonment Act.
Ms. Fisch approaches this work with the understanding that wrongful arrest, prosecution, and imprisonment are among the most severe failures of the justice system.
